
The Supreme Court has stayed the Allahabad High Court’s ruling that downgraded charges against two men accused of sexually assaulting an 11-year-old girl in Uttar Pradesh. The high court’s decision sparked widespread criticism for being “insensitive and inhuman.”
Case Details:
– In 2021, two men, Pawan and Akash, allegedly molested a minor girl, attempted to drag her under a culvert, and fled when people came to her rescue.
– The trial court had charged them with attempted rape under the POCSO Act.
– On March 17, the Allahabad High Court reduced the charges to assault and aggravated sexual assault, arguing that the crime had not progressed beyond preparation.
– The ruling led to public outrage, with many lawyers and politicians condemning it.
The Supreme Court took suo motu action after an NGO, We the Women of India, raised concerns. It has asked the Attorney General and Solicitor General to assist in the case and scheduled a hearing for April 15.
