Pathankot Court Temporarily Discharges Rahul Gandhi and 98 MPs from Legal Case

A Pathankot court has granted temporary relief to Leader of Opposition Rahul Gandhi, AICC President Mallikarjun Kharge, PPCC President Amarinder Singh Raja Warring, and 98 other MPs, discharging them from a legal case filed by a local advocate. The orders were issued by Judicial Magistrate Ravneet Kaur Bedi, with the next hearing scheduled for April 19.

The court ruled that under the latest legal provisions of Section 223 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), all respondents, including Gandhi, were discharged for the time being. Vikrant Mahajan, the counsel for Rahul Gandhi, stated that the court found the legal threshold for proceeding against them had not been met yet. He noted that if evidence arises in the future, the court may take further action.

The case was brought by complainant Tarsem Lal, who filed a petition alleging that the Congress party’s promise of Rs 8,500 per month to women ahead of the 2024 General Election was a deceptive ploy aimed at misleading voters. Lal claimed this constituted a criminal breach of trust, as it was a bait offered to secure votes.

During the court proceedings, Mahajan referenced Section 223 of the BNSS, which provides procedural safeguards for summoning individuals in such cases, emphasizing the importance of meeting legal requirements before proceeding with charges.
